  • Registration Data: When you sign up as a Local (Referrer) or Merchant, we collect your full name, email address, phone number, and password.
  • Merchant Business Data: If you are a Merchant, we collect your business name, address, website URL, and details about the services you offer.
  • Payment & Financial Data:
    • WE DO NOT STORE FULL BANKING CREDENTIALS. All financial data (bank account numbers, routing numbers, credit card details) is collected and processed directly by our third-party payment processor, Stripe.
    • We may collect partial payment information (e.g., last 4 digits) or tax identification numbers (SSN/EIN) strictly for tax reporting purposes (e.g., Form 1099-K) if required by law.
  • Communications: Any information you provide when you contact our support team or communicate with other users via the Platform.
  • Referral Inquiry and Booking Data: If you submit a service inquiry or booking through a referral link, we collect the information you provide in that request, the listing or business you contacted, and the referral link or Referrer associated with the request so that the business can respond and the referral can be tracked.

B. Information We Collect Automatically

  • Usage Data: We collect information about how you use the Platform, such as the referral links you click, the pages you view, and the dates/times of your visits.
  • Device Data: We collect information about the device you use to access the Platform, including IP address, browser type, and operating system.
  • Cookies: We use cookies and similar tracking technologies to track the activity on our Platform and hold certain information (e.g., keeping you logged in).

3. HOW WE USE YOUR INFORMATION

  • To Provide Services: To create and manage your account, track referrals, and facilitate the calculation of commissions.
  • To Process Referral Inquiries: To route service inquiries and booking requests to the appropriate Merchant, associate those requests with the applicable Referrer, and support commission tracking where a referral results in a completed transaction.
  • To Facilitate Payments: To transmit necessary data to Stripe so that Merchants can pay Locals and we can collect our Platform Fee.
  • To Connect Users:
    • For Merchants: To display your business listing to Locals.
    • For Locals: To allow Merchants to identify who sent a referral (e.g., sharing your name with the Merchant so they can verify the lead).
  • Communication: To send you administrative information, such as updates to our terms, security alerts, and payment notifications.
  • Fraud Prevention: To monitor and prevent fraudulent referrals, spam, or abuse of the Platform.
  • Legal Compliance: To comply with applicable laws, including tax reporting obligations (IRS) and responding to lawful requests from public authorities.

4. REFERRAL LINKS, COMMISSION DISCLOSURE, AND RELATED DATA

ReferToday operates a referral marketplace where registered members ("Referrers") may earn a commission when a customer books a service through their referral link. By submitting a service inquiry or booking through a referral link on ReferToday, you acknowledge that the person who referred you may receive a referral commission from the service provider. This commission is paid by the business and does not affect the price you pay for any service.

To operate this referral process, we may use and share referral-related information, including the submitted customer contact details, requested service details, listing, Merchant, Referrer, referral status, and transaction information needed to validate, administer, dispute, or pay referral commissions.

5. SHARING YOUR INFORMATION

We do not sell, trade, or rent your Personal Information to third-party advertisers for their marketing purposes. We share your information only in the following situations:

  • With Service Providers: We share data with third-party vendors who perform services for us, specifically:
    • Stripe: For payment processing and identity verification.
    • Hosting Providers: (e.g., AWS, Google Cloud) to host our Platform.
    • Email Services: To send transactional emails.
  • Between Users (Essential for Functionality): When a Local makes a referral, the Merchant may receive the Local's name and details of the specific referral to verify validity. When a customer submits an inquiry or booking through a referral link, the Merchant may receive the customer's submitted contact and request details, and the Referrer may receive referral status information reasonably necessary to track whether a commission has been earned.
  • Business Transfers: If Refer LLC is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
  • Legal Requirements: We may disclose your information where we are legally required to do so to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process (e.g., in response to a subpoena).

6. YOUR DATA RIGHTS & CHOICES

  • Account Information: You may review, update, or delete the information in your account at any time by logging into your account settings.
  • Marketing Emails: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails. (Note: You will still receive administrative emails regarding your account and payments).
  • Account Deletion: You may request to delete your account. Note: We may retain certain financial transaction records for a period of time (typically 7 years) as required by tax laws and financial regulations, even after you close your account.
